Three important decisions have been announced by the European Patent Office Enlarged Board of Appeal:
Decision G2/08 held that new and non-obvious uses of medicaments in the treatment of illnesses which they were previously known to treat, for example new dosage regimes, are patentable, and that the “Swiss” claim format will not be permitted for claiming medical use inventions in European patents having a filing or priority date more than 3 months after the decision is formally published (expected later this year).

The new levels applying to fee payments on or after 1 April 2010 represent an increase of around 5%. Although in some cases early payment of fees might be considered in order to avoid the increase, the potential benefit will need to be balanced against available budget resources and the additional administrative cost and effort of bringing forward actions needed to enable fees to be paid early.

From 1 October 2009, trade mark applications filed online at the UKIPO cost £30 less. The fee is £170 for one class plus £50 for each further class. There is also a new service named “Right Start”, under which only half the filing fee is paid at the outset.

Haseltine Lake’s new office in the Netherlands was launched at the “Meet the Judges” event held by the Benelux Licensing Executive Society (LES) on 26 January. Haseltine Lake sponsored the networking drinks reception for seminar delegates at the internationally renowned Peace Palace (“Vredespaleis”) in The Hague.
