CHANGE IN UK TRADE MARK OPPOSITION DEADLINE WITH IMMEDIATE EFFECT

The UK IP Office has just changed its practice relating to oppositions in the UK. The practice concerns the opposition deadline of all UK applications and International registrations designating the UK and has been implemented with immediate effect.
The UK IPO has now determined that the correct interpretation of the provisions in the Trade Marks Rules relating to oppositions means that the term for filing either an opposition or an extension to oppose an application or IR designation in the UK falls 1 day prior to the date two months after the publication date.
For example, if a UK trade mark application was published on 24 September, it must be opposed (or an extension of the opposition period filed) on 23 November at the latest.
The published change does not affect any other deadlines in the opposition procedure.
Please therefore immediately check any opposition deadlines on your records for UK applications and UK designations of International registrations and amend the opposition deadlines in line with the new practice.
