New possibility to include Moldova in European patent applications

03 May 2016

Last year we reported that it was possible to include Morocco on all PCT and European patent applications filed on or after 1 March 2015, following an agreement entered into in 2010 between Morocco and the European Patent Office. Following this, validation of European patents for the Republic of Moldova has recently become possible, pursuant to an agreement entered into between Moldova and the European Patent Office.

Similarly to Morocco, validation for Moldova is available on all PCT and European patent applications filed on or after 1 November 2015, provided that the applicant pays the validation fee of €200. The deadline for payment of the validation fee corresponds to the normal deadline for paying the designation and extension fees to designate, respectively, contracting states and extension states in a European patent application.

Therefore, when instructing a firm to file a European patent application or to enter the EP regional phase of a PCT patent application filed on or after 1 November 2015, it is important to remember to include whether you would like to pay the validation fee for Moldova, in the instructions.
