Haseltine Lake responds to consultation on draft rules for Europe’s new Unified Patent Court

Draft Rules of Procedure for the new Unified Patent Court (UPC) have been put out to a public consultation which closed on 1 October 2013. Haseltine Lake has responded on those aspects of the draft Rules which will be of significant importance to UPC users when the court comes into being. In particular, the need for a “sunrise provision” to enable patentees to opt out of the jurisdiction of the UPC prior to it being open for business (in order to ensure a third party revocation action does not get there first), the importance of parties being able to seek leave to appeal on interim matters from the Court of Appeal (rather than the judge who just made the decision) and the issue of fees (in relation to which there has been very little guidance thus far). The new UPC is currently likely to come into existence in early 2015.
